Surprisingly enough, it actually IS LEGO - although many of us would like to forget about that shamefull time, when LEGO produced such characters. It is a pirate from the 4+ or 4juniors series, back in 2004 - see him on Bricklink here. Since you have him holding a sword and jug, I would guess that he is from set #7080.
