All that means to me is that LEGO is not having it as part of a promo. It does not stop another retailer from possibly getting them as part of a promo, and with both Captain Marvel and Endgame coming this year Ill hold out hope as I would rather not pay 50+ USD for the set.
(Spending $50.00 to get a $7.99 freebie is pretty standard for Christmas freebies.)
(And completely over-charging for them was TRU's speciality. I'm mildly happy I don't have to be aggravated about the Bricktober promos.)

I have a couple of points with my long story. TRU failed for many reasons and this is just one of them. I don't care if they come back or not. I know the executives ran the company into the ground and the company treated their employees like crap, so that's probably why so many exclusives "fell of the truck" and/or employees just didn't care enough to.follow proceedure.
As far as TLG is concerned; if their reps care as little as the rep I encountered that day; then shame on TLG. That is why I don't take things lying down with Lego Customer Service anymore. If I'm not happy with a purchase, I'll call and complain. I'm very nice when I call, but I won't except damaged boxes directly from them anymore.
But I see your point. Apathy in the retail sphere is one of the many reasons why businesses go under or bankrupt.
And why we have the freedom to vote with our feet and not buy product at a particular retailer.
I get the feeling that given the sheer scope of the American market things are just very different down there in general. Like, we don't see instant sales on new merchandise and other hiccups that I see commonly reported here, even at equivalent retailers like Walmart. Everything is very orderly (albeit quite a bit more expensive).
The Bricktober Promotion, at least from that particular year, was that if you bought $50 worth of Lego you received that weeks Bricktober set. My parents went to their TRU and bought a Ninjago set and received the Ninjago Bricktober set. After that week was up and the next Bricktober set was in play, if there were any left over Bricktober sets from the previous week, you could purchase them for $19.99. You could ONLY purchase the leftover sets, NOT the current Bricktober set for that week.
...or maybe I'm just old and cranky :)
It'd be nice if the return clerks were more savvy, but I can see why they're not hyper aware of the differences between each and every character across dozens of waves every year. Outside of my own interests, I can't distinguish much of what I see on store shelves.

No, it's really not. As @pharmjod said, there's not nearly enough time to do any of that checking. You could literally train a person to recognize every possible variance to an altered product, and they still wouldn't have the time to review everything. Try to do that at a Wal-Mart here in the states and you'd have a bona fide riot on your hands from everyone else waiting in line. You'll just never get the sort of attention and care needed at big retail stores. Only in smaller shops would they have the ability to do that, and that's likely not where you'd see the issue.
