Im guessing to not show LEGO figures in Peril.. There was a whole debate about this I think either earlier in this thread or another. I do not think they want to show LEGO 'people' in danger in the set.
An abandoned building is a much safer set, and still allows kids to fight fires.
Your statement "If a toy is too far out there then it wont sell" is the primary factor here. Sure, TLG could learn what toys sell through trial and error, but if they have good reason to think a toy will sell just as well or better if they avoid things that might scare kids, why even bother taking the risk?

IMO X-Men doesn't need a movie tie in to be successful. The X-Men are timeless. One set is not enough!
DC got a large Arkham set, so I feel like the obvious Marvel counterpart would be The Xavier Institute.
With the new Wolverine film, and an X-Men first class sequel, I would hope we get some Lego tie in sets like the Wolverine helicopter.
Plus, the Jean Grey minifig exclusive looked awesome and I want more like it.
As a side note, in Kotor2 I remember turning the Darth Maul looking guy to Sith. He was probably the most good / jedi character of the bunch. It was super difficult but super fun.
