That's an embargo for sites posting the pictures and places selling them. I'd imagine someone posting a picture of something they saw in the wild isn't the same. He didn't break the embargo, the Walmart did by putting them on the shelves.
I have a TRU that does this all of the time. And it's hit or miss whether they'll sell the sets to you or not. Sometimes they ring up fine and sometimes I get "oh we can't sell that until Saturday." Well, then you might want to take the 50 of them off the shelf that you put out because you're going to have a lot of people trying to buy them until then.
