    Your listing state the item as "new", if you had them put in display and removed, they are not new. They might be like new, but they do not fit the definition of new and should be listed as used.

    ^ He says the ones in the picture are his ones, and that most of the ones for sale have never been assembled.

    Although its being pedantic, I think @Dawn‌ is correct that on eBay a 'new' listing is something still sealed in original packaging; as soon as its opened then its 'used'.

    Personally, I'm happy to accept minifigs straight out of the bag and into a gripseal bag as 'new'.

    I think it's a fair point.

    I pondered what to put as I've sourced the figures from various places including directly out of their original boxes, Bricklink and "new" from eBay itself so I hope the disclaimer in the description is fair.

    As CCC says, the figs in the pictures are all stunt doubles taken from my collection, but I think the guidelines are a little ambiguous when it comes to things like this that have been created specially for sale.

    I guess I'm working to the logic that if I'd sculpted something from clay I would still list the sculpture as new, even though the clay had been "used" to make it...and their was no original packaging.

    I have also just tweaked the wording in the eBay listing as I do value the feedback and I'm looking to sell a collection someone will be delighted by.
